Terms and Conditions

Please read these terms carefully before accessing or using the PixHub platform. By creating an account or using any feature of the service, you expressly accept these terms in full. If you do not agree with any of the provisions below, do not use the Platform.
1. Definitions
Throughout this document, the following terms have the meanings set out below:
"Platform" / "Service" — the pixhub.ro website and all of its features, including the API, hereinafter referred to as "PixHub", "we", "us", or "the operator".
"User" — any individual or legal entity that accesses or uses the Platform, whether or not registered with an account.
"Account" — the personal account created by a User to access the Platform's extended features.
"Content" — any file (image, video), text, comment, metadata, or other material uploaded, transmitted, or generated by a User through the Platform.
"Third-party content" — any content created by other users or sourced from external platforms.
"API" — the Application Programming Interface made available by PixHub, accessible via an authentication key.
"DSA" — Regulation (EU) 2022/2065 of the European Parliament and of the Council on a Single Market for Digital Services (Digital Services Act).
"GDPR" — Regulation (EU) 2016/679 of the European Parliament and of the Council on the protection of natural persons with regard to the processing of personal data.
2. Acceptance of Terms
This document constitutes a binding legal agreement between the User and PixHub, governed by applicable Romanian and European law. Using the Platform implies full and unconditional acceptance of these terms, the Privacy Policy, and the Cookie Policy.
PixHub may modify these terms at any time. Significant changes will be announced by email or through a visible notice on the Platform at least 15 days before they take effect. The updated version applies from the date of publication. Continued use of the Platform after the changes are published constitutes tacit acceptance of the new terms. If you do not agree with the changes, please stop using the Platform and request deletion of your account.
3. Eligibility and Legal Capacity
The Platform is intended for individuals who are at least 16 years old. By using the Service, you represent and warrant that you meet this age requirement and that you have the legal capacity to enter into binding contracts. Individuals between 16 and 18 years of age use the Platform under the responsibility of a parent or legal guardian, who is responsible for compliance with these terms.
Users who upload, distribute, or access adult content must be at least 18 years old and must ensure that everyone depicted in that content is an adult and has given explicit, documented consent, in accordance with applicable law.
Users acting on behalf of a legal entity warrant that they have the authority required to bind that entity to these terms.
4. Description of the Service
PixHub is a free file hosting and distribution platform for images and videos. PixHub acts as an intermediary hosting service provider within the meaning of Art. 6 of Directive 2000/31/EC on electronic commerce and Art. 6 of the DSA, storing information provided by users at their request, without exercising prior editorial control over the Content.
The Services include, without limitation:
Hosting and distributing images and videos via direct links, dedicated pages, and embed code;
Organizing files into albums;
View and interaction statistics;
An API for programmatic integration;
A user account for managing your own files.
PixHub does not guarantee that the Service will be available continuously, uninterrupted, or error-free. The Platform may be temporarily unavailable for maintenance, updates, or technical reasons beyond our control.
5. User Account
5.1. Registration
Creating an account requires a unique username, a valid email address, and a password. By registering, you agree to provide accurate, complete, and current information, and to keep it up to date for as long as you use the Platform.
5.2. Account Security
You are solely responsible for:
Keeping your password and all access credentials confidential;
All activity carried out through your account, whether or not authorized by you;
Immediately notifying PixHub at [email protected] of any unauthorized use or suspected compromise of your account.
PixHub will not be liable for losses arising from unauthorized use of your account if we were not notified in a timely manner.
5.3. Account Restrictions
You may not:
Create multiple accounts to evade restrictions or sanctions applied to you;
Create accounts on behalf of other people without their explicit consent;
Transfer or assign your account to a third party without PixHub's written consent;
Use automated credentials (bots) to create accounts in bulk.
6. User Content
6.1. Ownership and License Granted
The User retains all intellectual property rights in the Content they upload. By uploading Content to the Platform, you grant PixHub a non-exclusive, royalty-free, worldwide, sublicensable license to:
Store, reproduce, and display the Content for the purpose of providing the Service;
Generate thumbnails and optimized derivative formats;
Distribute the Content through CDN networks and the Platform's technical infrastructure;
Display the Content on the Platform's pages, in search results, and through embed features.
This license terminates when the Content is deleted from the Platform, except for technical backup copies that may be retained temporarily in accordance with backup policies.
6.2. User Representations and Warranties
By uploading any Content, you represent and warrant that:
You hold the necessary rights or have obtained all applicable authorizations, consents, and licenses from the rights holders and/or the individuals depicted;
The Content does not infringe any copyright, related right, right of publicity/image right, trademark, patent, trade secret, or any other right of a third party;
The Content does not contain personal data of third parties published without their consent;
The Content fully complies with these terms and applicable Romanian and European law.
The User is solely responsible for the Content they upload and for any legal, civil, or criminal consequences arising from it. PixHub does not review, edit, or approve Content before publication.
6.3. Sharing and Embedding
Public files can be shared via direct link, BBCode, Markdown, or <iframe> embed code. By setting a file's visibility to "public", you explicitly authorize third-party users to access and embed that Content on other platforms using the means made available by PixHub. Private files are accessible exclusively to the account holder.
7. Prohibited Content
It is strictly prohibited to upload, distribute, store, or facilitate access to any Content that:
7.1. Unlawful Sexual Content
Depicts or contains child sexual abuse material (CSAM) — a serious criminal offense under Art. 374 of the Romanian Criminal Code, Law No. 196/2003, and Directive 2011/93/EU. Any such content will be removed immediately and reported to the competent authorities (Police, DIICOT, INHOPE);
Distributes intimate images or videos without consent (revenge porn) — punishable under Art. 226(3) of the Romanian Criminal Code.
7.2. Violent and Extremist Content
Incites hatred, discrimination, or violence on grounds of race, ethnicity, nationality, religion, sex, sexual orientation, disability, or any other protected characteristic — under Romanian Government Ordinance No. 137/2000 and Council Framework Decision 2008/913/JHA;
Promotes, glorifies, finances, or facilitates terrorist, extremist, or violent radicalization acts — under Romanian Law No. 535/2004 and Regulation (EU) 2021/784 on addressing the dissemination of terrorist content online;
Contains graphic depictions of extreme violence without documented informational or artistic purpose.
7.3. Illegal and Fraudulent Content
Infringes copyright, related rights, or other intellectual property rights without authorization — under Romanian Law No. 8/1996 on copyright and related rights;
Constitutes defamation, slander, or insult — under Articles 205-206 and 238-239 of the Romanian Criminal Code;
Is used for fraudulent activity, phishing, social engineering, or deception — under Articles 244-249 of the Romanian Criminal Code and Law No. 365/2002;
Publishes third parties' personal data without their consent (doxxing) — under the GDPR and Romanian Law No. 190/2018;
Contains malware, viruses, trojans, ransomware, or any code designed to damage computer systems — punishable under Romanian Law No. 161/2003 on measures to ensure transparency in the exercise of public office, as well as other cybersecurity provisions.
7.4. Other Prohibited Content
Content that facilitates the sale or distribution of controlled substances, weapons, or products whose sale is regulated or prohibited;
Spam or unsolicited bulk advertising content;
Content that imitates or impersonates PixHub, its employees, or its partners;
Any other content that violates applicable Romanian or European law.
8. Intellectual Property
8.1. PixHub's Ownership
The PixHub Platform, including its source code, design, logo, interfaces, names, documentation, and all its features, is protected by copyright law, trademark law, and other intellectual property laws. These elements are the exclusive property of PixHub or its licensors.
No part of the Platform may be reproduced, distributed, modified, decompiled, reverse-engineered, or otherwise used without PixHub's prior written consent, except as expressly permitted by law.
8.2. Trademarks
The "PixHub" name and associated logo are trademarks of the operator. You may not use these marks for commercial or advertising purposes, or in any other context that could create confusion regarding an affiliation with PixHub, without prior written consent.
8.3. Feedback and Suggestions
If you submit suggestions, ideas, or feedback about the Platform, you grant PixHub an irrevocable, non-exclusive, royalty-free right to use, implement, and exploit them without any obligation to you.
9. Use of the API
API access is granted exclusively to authenticated users holding a valid API key generated from their personal account. By using the API, you additionally agree that:
Your API key is personal and non-transferable — do not share it or include it in publicly accessible source code;
You are responsible for all operations performed using your API key;
You will respect the rate limits and per-request costs documented at Rate Limiting;
You will not use the API for abusive automated activity (unauthorized crawling, bulk account creation, spam);
PixHub may revoke API access without prior notice in the event of abusive use.
10. Content Moderation Policy (DSA)
In accordance with Regulation (EU) 2022/2065 (DSA), PixHub maintains a notice-and-action mechanism for illegal content, available at pixhub.ro/en/report-abuse. Our moderation policy follows the principles of transparency, proportionality, and objectivity.
10.1. Notice Process
Anyone may notify PixHub of Content they consider illegal by providing the information required in the report form. Each notice is reviewed diligently and without undue delay. Manifestly illegal content (e.g., CSAM, terrorism) is suspended immediately, without requiring prior in-depth review.
10.2. Moderation Decisions
PixHub may, at its own discretion or following a notice, remove, restrict access to, or flag Content that:
Violates these terms;
Is illegal under applicable law;
Is reported by a competent authority.
A User whose content is removed or restricted will be notified, with the reasons and the available means of appeal.
10.3. Right to Counter-Notice and Appeal
If you believe a decision to remove or restrict your content was made in error, you may submit a counter-notice to the address indicated in the notice you received, within 14 calendar days of the decision being communicated. PixHub will re-review the case and communicate its final decision within 14 days of receiving the counter-notice.
Users within the European Union may also resort to a certified out-of-court dispute settlement body in accordance with Art. 21 of the DSA.
11. Service Availability and Maintenance
PixHub makes reasonable efforts to ensure the Platform's availability but does not guarantee any specific level of availability (SLA). The Platform may be temporarily unavailable due to:
Planned maintenance activities (announced in advance where possible);
Technical failures of the infrastructure or of third-party providers;
Cyberattacks, force majeure, or other unforeseeable events.
PixHub is not liable for losses caused by service interruptions, regardless of their duration, to the extent permitted by applicable law.
12. Limitation of Liability
In accordance with Art. 6 of Directive 2000/31/EC and Art. 6 of the DSA, PixHub is not liable for Content stored at the request of users, provided that, upon obtaining actual knowledge of illegal Content, it acts promptly to remove or disable access to it.
PixHub does not warrant and is not liable for:
The accuracy, completeness, or legality of third-party Content;
The content of external websites linked to from the Platform;
Indirect, incidental, special, or consequential losses arising from the use or inability to use the Platform;
Loss of data, profits, or business opportunities;
The actions or omissions of third parties using Content shared through the Platform.
PixHub's total liability toward any User, regardless of the legal basis of the claim, will not exceed EUR 100 or, if greater, the value of the subscriptions paid by the User in the 12 months preceding the damaging event.
These limitations apply to the maximum extent permitted by applicable law. Some jurisdictions do not allow the exclusion or limitation of certain types of liability; in such cases, the above limitations apply to the extent permitted by law.
13. External Links and Third-Party Content
The Platform may contain links to third-party websites or allow the embedding of external content. Such links are provided for reference only and do not constitute an endorsement, recommendation, or affiliation on the part of PixHub. PixHub does not control the content, privacy policies, or practices of third-party sites and cannot be held responsible for them. You access third-party sites at your own risk.
14. Suspension and Termination of Access
14.1. By PixHub
PixHub may suspend or close an account, with or without prior notice, if the User:
Violates these terms, in particular the provisions on prohibited content;
Provides false information during registration or while using the Platform;
Uses the Platform for fraudulent, illegal, or abusive purposes;
Repeatedly infringes the intellectual property rights of third parties;
Misuses the API or exceeds the established limits;
Poses a security risk to the Platform or other users.
In the event of suspension, the User will be notified by email with the reasons and possible means of appeal, except where notification would hinder the investigation of illegal activity.
14.2. By the User
The User may request account closure at any time through the settings section or by contacting our team at [email protected]. Upon account deletion, Content may be anonymized (disassociated from the account and retained as anonymous content) or removed, according to the User's choice expressed at the time of the request, within the limits set out in the Privacy Policy.
14.3. Effects of Termination
Termination of access does not relieve the User of responsibility for Content uploaded previously or for obligations incurred under these terms before the termination date. The sections on intellectual property, limitation of liability, warranties given, and governing law survive termination of this agreement.
15. Force Majeure
PixHub will not be liable for any failure or delay in performing its obligations where this is caused by a force majeure event, understood as any external, unforeseeable, and insurmountable event, including but not limited to: natural disasters, pandemics, armed conflicts, acts of public authorities, large-scale power outages, large-scale DDoS cyberattacks, or major failures of internet infrastructure.
16. Modification and Discontinuation of the Service
PixHub reserves the right to modify, suspend, or permanently discontinue any feature of the Platform, at any time, with or without prior notice, without being liable to Users or third parties for such changes. In the event of permanent discontinuation of the Service, PixHub will notify registered users at least 30 days in advance and will provide a way to export their own Content.
17. Communications
Official communications from PixHub will be sent to the email address associated with your account or published on the Platform. You are responsible for keeping your email address up to date and for checking your messages regularly. Communications sent to your registered email address are deemed received on the date they are sent.
Communications from the User to PixHub should be sent to [email protected] or through the contact form available on the Platform.
18. Entire Agreement and Severability
These terms, together with the Privacy Policy and the Cookie Policy, constitute the entire agreement between the User and PixHub regarding use of the Platform and supersede any prior understandings, written or verbal, relating to the same subject matter.
If any provision of these terms is declared invalid, void, or unenforceable by a competent court or authority, that provision will be removed or limited to the minimum extent necessary, and the remaining provisions will remain in full force and effect.
PixHub's failure to exercise any right under these terms does not constitute a waiver of that right.
19. Governing Law and Dispute Resolution
These terms are governed by and construed in accordance with Romanian law, subject to applicable European Union law. Any dispute arising out of or in connection with these terms will first be resolved amicably, through direct negotiation between the parties, within 30 days of being raised.
In the absence of an amicable agreement, disputes will be submitted to the competent courts of Romania, except where applicable law requires a different jurisdiction.
Consumers within the European Union are entitled to use:
The European Commission's Online Dispute Resolution (ODR) platform: ec.europa.eu/consumers/odr;
The services of the Romanian National Authority for Consumer Protection (ANPC), Bd. Aviatorilor nr. 72, Bucharest: anpc.ro;
An alternative dispute resolution (ADR) body agreed upon by mutual consent.
